These Conditions of Sale are drafted in accordance with the legal provisions of the Italian Civil Code, the Legislative Decree. n. 70/2014 regarding Information Society Services and Electronic Commerce, the Consumer Code and governing the offer and sale of products through the site www.Biancamilano.com. (“the Website”)

Products marketed on www.Biancamilano.com are sold directly by da Milor S.p.A., with registered office in Milano Via dei Gracchi 35 VAT n.04362490155 (hereinafter referred indifferently as "Seller"),

SCOPE

The General Conditions of Sale apply and govern all sale contracts signed on the Website by the Seller, as identified above.

The General Conditions of Sale may be subjected to modification and the User is obliged to consult them before making any purchase.

It is User’s duty to check the Terms and Conditions of Sale before placing the order.

Before confirming third parties’ orders, the User must check the Terms of Sale.

Conditions of Sale apply regardless of User nationality, provided that the delivery of products takes place in one of the Countries in which the site provides on-line sales service and that the Country corresponds to the one where the User has made his registration.

The purchase of products on the Site is limited exclusively to any natural person who is acting as consumer and is over the age of majority.

Consumer means any natural person acting for purposes other than trade, business, craft and professional activities.

CONCLUSION OF THE CONTRACT

These Conditions of Sale are an integral and essential part of the sale contract between the Seller and the User.

The submission of the order by the User implies full knowledge and acceptance of these General Conditions of Sale and Use and of the Privacy Policy.

If the User does not agree with any term of these Conditions of Sale is requested to refrain from make any purchase on the Site.

In order to submit an online order, the User shall give all the necessary data to the Seller, to allow the correct execution of the order, according to privacy policy law.

To conclude the purchasing contract the User shall send the order by following the procedure on the Site.

The submission of order obliges the User to pay the indicated price.

To complete the purchase, the User is obliged to confirm the payment of the price of the products in the shopping cart.

In case of failure of the payment, the order will be automatically cancelled.

After the submission of the order, the User will receive an e-mail confirming the purchase and containing the summary of the order.

This communication is not to be intended as an automatic acceptance of the order.

The Seller keeps the right to reject orders which are incomplete and incorrect, or order made by users with whom the Seller has an ongoing dispute concerning the payment of a previous order.

In such a case the User will receive a specifically motivated rejection by e-mail.

If the products presented on the Site are not available at the time of last access or at the time of the submission of the order, the Seller will communicate to the User the unavailability of the product within 5 working days from the day after the purchase.

In the case that the payment has already been done, the Seller will refund the User the price without any further compensation.

In the order form the User will find:

- the accepted payment methods;

- delivery methods;

- shipping costs;

- conditions of right of withdrawal;

- time and procedure of return of purchased products;

The languages of the contract are Italian and English.

PRODUCT FEATURES

The products sold on the Site are top-quality products.
Seller does not sell second-hand products, flawed products or products of lower quality than the corresponding market standards. The main characteristics of products are shown on www.Biancamilano.com on each product page. The products offered for sale on www.Biancamilano.com may not exactly correspond to the real garments in terms of image and colors due to the Internet browser or monitor used.

Prices are subject to change and will be as quoted on our site from time to time, except in cases of obvious error. Check the final price of sale before sending the relevant order form.

All Products sold by Seller come with an identification tag. When trying on the products you should not remove or alter the tag from the purchased products should you wish to return the purchased product.

The catalogue can be periodically updated and modified, therefore the availability of a product could not be always guaranteed.

Each product is described by a card in which all the essential features are specified; the images and the colors of the products may not correspond to the real product due to the computer and browser settings.

Therefore, the images of the products should be considered approximate.

SALES PRICES

All the sales prices of the products have to be intended VAT included (if applicable in the Country of delivery), as well as other taxes which may be applicable to the sale.

Product prices may be subjected to updates and modifications. The User shall verify the final price of sale before submitting the order.

In case of an evident mistake on the price displayed on the Site, compared to the known market price of the product, the Seller shall keep the right to confirm the delivery and to reimburse immediately the amount of money already paid by the User.

VALUE VOUCHERS

Value vouchers are personalized codes which allow you to take advantage of a discount on your purchase on www.Biancamilano.com.

Restrictions to the use of value vouchers:

The value voucher can be used only once, with the exception of returns;

The value voucher cannot under any circumstances be exchanged for money;

You may not use more than one value voucher per order;

The value voucher can be applied only to one item per order;

The value voucher can be applied only to items with a higher value than the voucher itself;

The value voucher cannot be applied to any Sample Sale or Charity Sale items.

In accordance with consumer protection legislation, if for any reason you wish to return the item to which you applied the value voucher, you should follow the standard return procedure, as described in the section. Once your return has been accepted, the respective code will be restored to its original value. The difference in price between the value voucher and the item you purchased will be reimbursed, according to the time frame of the applicable refund procedure.

VALUE VOUCHERS COULD NOT BE ALREADY AVAILABLE. IN NO EVENT SHALL SELLER BE LIABLE TO USER FOR THE LACK OF AVAILABILITY OF VALUE VOUCHERS

PAYMENT METHODS

For the payment of the price and of the delivery costs (if any) the User will follow the procedure specified in the order.

In the event of payment by credit card, the payment procedure takes place via a protected connection directly to the bank and the on-line payment service, to which third parties have no access. In particular, the financial information (such as, for example, the credit/debit card number or its expiry date) will be submitted, using a cyphered protocol, to other banks that supply the relative remote electronic payment services, without third parties being able to access them in any way. Furthermore, this information will never be used by the Seller for purposes other than completing the relative purchase procedures and to issue the required reimbursements in the event of product restitutions, following the exercise of withdrawal rights, or if it is necessary to prevent or report to the police any fraudulent acts perpetrated on the Web Site.

The amount of the order will be charged the day of shipment, without prejudice to the customer's right to be refunded the amount in the event of breach by the Vendor or non-performance of the contract for any reason whatsoever.

The customer is solely responsible for all data provided and guarantees the use of credit cards of which only he/she is an authorized user.

DELIVERY METHODS

The products are delivered via affiliated couriers, directly to the User, at the delivery address specified during the order phase.

In completing the registration procedure, is required for the execution of this contract and all relative correspondence, that the User authorizes the Seller to notify his/ her personal data to the curriers and/ or shipping companies used to deliver the purchased goods, in order to allow their delivery.

The Seller will do everything in its power to process the order within 2 days and in any case no later than 30 days from the following day the payment has been made.

Delivery times are calculated based on working days and do not include public holidays.

This Site allows the delivery of the products to be requested at an address that is different to the User’s own, provided that it is within Country where the order can be delivered; in any case, it is responsibility of the User to specify all the necessary details for successful delivery.

It is never possible to collect the products that were purchased via the Site directly from the Seller’s warehouse.

The costs and types of delivery offered may vary according to the Country and the method of delivery chosen by the User.

These costs and any additional cost shall be borne by the User. The charges will be clearly and separately indicated on the order summary, before the User continues the transmission of the said order, as well as in the confirmation e-mail.

Both in Italy and abroad the delivery process requires that, in the event that the recipient is absent when the courier arrives, the courier leaves a card with contact details to organize a second delivery, in order to successfully complete the delivery. In the event of delivery's failure due to the recipient’s absence at the time when courier attempts to carry out delivery, the package will remain in storage. It will be a User’s duty to take care of the collection.

In the event of lack of collection within 4 days, the package will be returned to the Seller. In such a case, the contract will be considered terminated pursuant to art. 1456 of the Italian Civil Code, via simple notification from the Seller sent by email to the User and therefore the order will be considered cancelled for all purposes.

The User always has the option of checking the status of his/her order through a link, inserting his/her order number or through his/her personal area if the user has registered on www.Biancamilano.it.

USER OBLIGATIONS

It is strictly forbidden for minors to place orders on the Website.

The data entered when purchasing must exclusively be the actual User's personal data and not that of third parties, or invented data. The Seller reserves the right to prosecute all breaches and abuse, in the interests of and to protect all Users.

The User shall hold the Seller harmless of all liability deriving from the issue of incorrect tax documents due to errors in the data provided by the User, who shall remain the only party responsible for the correct input of data.

Upon receipt of the products the User must check that they conform to the order, paying attention in particular that the number of packages indicated on the carrier’s letter corresponds to the number of the packages delivered and if the packaging is intact.

Any faults (e.g. tampering, damage to the packaging) must be specifically indicated directly on the courier’s transport document, and the User should refuse the delivery. At the same time the User must notify the Seller’s customer service through a dedicated link.

If the User accepts the delivery of damaged or tampered products, the User shall forfeit the legal guaranty of conformity of the products.

RESPONSIBILITY

The Seller shall not be liable for any disservice caused by force majeure, including but not limited to accidents, explosions, fires, strikes and/or lockouts, earthquakes, flooding or similar events which wholly or partly impede the performance of the contract within the agreed time.

The Seller shall not be liable to any party or third parties concerning damage, losses or costs incurred due to the non-performance of the contract for the above-listed reasons, and the User shall have the right to receive only the refund of the price paid.

Equally, the Seller shall not be liable for the fraudulent or unlawful use by third parties of credit cards, checks or other means of payment used to pay for the purchased products. The Seller does not have access to the User’s credit card number at any time in the purchasing procedure, as the number is transmitted directly to the manager of the banking services.

RIGHT OF WITHDRAWAL

The User may exercise the right of withdrawal and return the goods received, without any penalties and without having to specify the reason, in compliance with the terms and methods indicated below.

The User may request to return goods by completing and submitting to the Seller the returns form received from the Customer Care within fourteen (14) days from the delivery of the goods and following the procedure laid down therein.

Goods must be returned intact, undamaged and bearing their bar-code labels and any other seals that are part of them; it is not possible to reimburse Users for goods that are returned incomplete, ruined or damaged.

As a Consumer you are entitled to various statutory warranties including a warranty that the products supplied to you conform with your contract with us.

All products sold by the Vendor are covered by a guarantee for lack of conformity, as provided by the applicable law. You shall inform the Vendor of the existence of any such lack of conformity within a period of two (2) months from the day when you detected the lack of conformity. Please contact our Customer Care.

The goods the User wishes to return must be delivered within fourteen (14) days, starting from the date on which the User notifies the Vendor of his/her decision to withdraw from the contract.

The cost of returning the goods will be borne by the User.

On return of the goods, the Seller shall check their conformity with the terms and conditions laid down in this paragraph.

If the right of withdrawal is exercised in the methods and terms indicated in this paragraph, the Seller shall refund the User any amounts received for the purchase of the goods net of delivery cost.

Whatever methods of payment are used by the User, the Seller shall arrange for the refund in the shortest possible time and in any case within fourteen (14) days from the date on which the Seller was informed of the exercise of the right of withdrawal, having checked the conformity of the withdrawal procedure and the returned goods.

The Seller generally refunds the amounts using the same method of payment used by the User when purchasing the goods. If a virtual credit card was used, or the credit card has expired, is about to expire or stolen, the User may send an email to Customer Care to agree the most appropriate repayment method.

WARRANTY OF CONFORMITY

Pursuant to the law, the Seller is obligated to deliver goods to the User that comply with the sale contract.

The Seller shall be liable to the User for any non-conformity of the Products that exist at the time of delivery of the aforementioned goods, or that occurs within two years of delivery.

To qualify for the above-mentioned guarantee, the User must notify to the Seller the non-conformity within two months from its discovery, or this right will be forfeited, by contacting Customer Services via a dedicated link: this notification must contain an accurate and complete description of the reported defects/faults.

Customer Services will respond to the User’s notification, giving instructions for the delivery of the defective product, which will be at the Seller’s expense.

The User shall be entitled to terminate the Contract and the refund of the amount paid, or, alternatively, the replacement of the product. In case of minor vice and defect, the User will be only entitled to the replacement of the product.

Any defects or damage caused by accidental means or those attributable to the User or those caused by use of the Products in a way that does not comply with its intended use or normal wear and tear, are excluded from the non-conformity and, therefore, from the legal guarantee.

APPLICABLE LAW

All disputes over the application, performance, interpretation or breach of the purchase contracts concluded on the website are governed by Italian law, without prejudice to local mandatory law applicable to Customer in its Country. The Application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.

AMENDMENTS AND UPDATES

The Seller reserves the right to alter this Website, its policies and these General Conditions of Sale at any time, in order to offer new products and services, or to comply with legal or regulatory provisions. Users accessing the Website and submitting an order shall comply with the policies and terms of the General Conditions of Sale in force at the time of placing the order, unless such amendments have retroactive effect pursuant to the applicable law. Should any of the provisions of these Conditions of Sale be deemed invalid or void or for any reason inapplicable, the condition shall not prejudice the validity and effectiveness of all other provisions.

I prodotti commercializzati su www.Biancamilano.com sono venduti direttamente da Milor S.p.A., con sede legale in Via dei Gracchi 35 Milano è iscritta al Registro delle Imprese della Camera di Commercio di Milano, C.F. / P. IVA n. 04362490155; (successivamente per brevità indicato come Venditore)

AMBITO DI APPLICAZIONE

Le Condizioni Generali di Vendita si applicano e disciplinano tutti i contratti di vendita conclusi attraverso il Sito del Venditore., come sopra identificato.

Le Condizioni Generali di Vendita possono subire delle modifiche e ciascun Utente è tenuto a consultarle prima di procedere ad ogni acquisto. È onere dell’Utente verificare le Condizioni Generali di Vendita prima di inoltrare l’ordine.

Le condizioni Generali di Vendita si applicano a prescindere dalla nazionalità dell’Utente, a condizione che la consegna dei prodotti debba avvenire in uno dei paesi per i quali il Sito prevede il servizio di vendita on-line che detto Paese corrisponda a quello di registrazione dell’Utente.

Le richieste di acquisto provenienti da Paesi non compresi fra quelli visualizzati nella splash page non potranno essere accettate dal Venditore.

L’acquisto di prodotti sul Sito è riservato in via esclusiva a persone fisiche che agiscono in qualità di consumatori e che siano maggiori di anni 18.

Per consumatore si intende ogni persona fisica che agisce per scopi estranei all’attività commerciale, imprenditoriale, artigianale e professionale eventualmente svolta.

CONCLUSIONE DEL CONTRATTO

Le presenti Condizioni Generali di Vendita sono parte integrante ed essenziale del contratto di vendita tra il Venditore e l’Utente.

L’invio telematico dell’ordine da parte dell’Utente implica totale conoscenza e integrale accettazione delle presenti Condizioni Generali di Vendita, d’Uso e dell’Informativa sulla Privacy. Qualora l’Utente non sia d’accordo con uno o più termini contenuti nelle presenti Condizioni Generali di Vendita è pregato di astenersi dall’effettuare acquisti nel Sito.

Per procedere all’acquisto online di uno o più prodotti, l’Utente dovrà fornire al Venditore, in ottemperanza alle disposizioni in materia di protezione dei dati personali, tutti i dati necessari per consentire a quest’ultimo di dare esecuzione agli ordini inoltrati.

Per perfezionare l’acquisto l’Utente è tenuto a confermare il pagamento del prezzo dei prodotti inseriti nel carrello. Gli ordini che non registrano la corrispondente transazione vengono annullati automaticamente.

Quando l’Utente effettua un ordine riceverà una e-mail che contiene la conferma del ricevimento dell’ordine ed il riepilogo del medesimo: questa comunicazione non costituirà comunque accettazione automatica dell’ordine.

Il Venditore si riserva il diritto di rifiutare gli ordini che risultino incompleti e non corretti o di utenti con i quali sia in corso una controversia relativa il pagamento di un ordine precedente. In tali eventualità l’Utente riceverà a mezzo e-mail il rifiuto dell’ordine specificamente motivato.

Qualora i prodotti presentati sul Sito non siano più disponibili al momento dell’ultimo accesso al Sito ovvero dall’invio dell’ordine, sarà cura del Venditore comunicare all’Utente, entro 5 giorni a decorrere dal giorno successivo a quello in cui è trasmesso l’ordine, l’indisponibilità del prodotto ordinato. In caso di avvenuto pagamento il Venditore provvederà a rimborsare il prezzo senza essere tenuto ad ulteriori risarcimenti.

Nel modulo d’ordine è contenuto un rinvio alle presenti Condizioni Generali di Vendita e all’Informativa sulla Privacy, nonché un riepilogo delle caratteristiche essenziali di ciascun prodotto ordinato ed il relativo prezzo, dei mezzi di pagamento accettati e delle modalità di consegna dei prodotti acquistati, dei costi di spedizione, delle condizioni per l’esercizio del diritto di recesso e delle modalità e dei tempi di restituzione dei prodotti acquistati.

L’Utente può, in ogni momento, monitorare lo stato del proprio ordine consultando l’apposito link/sezione o accedendo alla propria area personale.

Le lingue del contratto sono italiano e Inglese.

Le immagini ed i colori dei prodotti offerti in vendita su www.Biancamilano.com potrebbero tuttavia non essere corrispondenti a quelli reali per effetto del browser Internet e del monitor utilizzato. I prezzi dei prodotti potrebbero essere soggetti ad aggiornamenti.

Tutti i prodotti sono muniti di cartellino identificativo. Ti chiediamo di non rimuovere il cartellino ed il relativo sigillo dai prodotti acquistati, dei quali costituiscono parte integrante.

PREZZI DI VENDITA

Tutti i prezzi di vendita dei prodotti indicati all’interno del Sito sono comprensivi di IVA, se applicabile in ragione del paese di spedizione dei prodotti e di ogni altra imposta eventualmente applicabile alla vendita.

I prezzi dei prodotti potrebbero essere soggetti ad aggiornamenti e variazioni. L’Utente è tenuto ad accertare il prezzo finale di vendita prima di inoltrare il relativo ordine. Il palese errore materiale riportato nel prezzo presente nel Sito rispetto al prezzo comunemente noto del prodotto prescelto comporta la facoltà del Venditore di non confermare la spedizione e procedere con il rimborso immediato del valore dell’acquisto versato dall’Utente senza che questi possa opporre eccezioni in merito.

VALUE VOUCHER
I voucher a valore sono codici personalizzati che consentono di usufruire di uno sconto sugli acquisti effettuati su www.Biancamilano.it.

Limitazioni all'utilizzo del voucher a valore:

Il voucher a valore è utilizzabile una sola volta, salvo resi;

Il voucher a valore non potrà in alcun modo essere convertito in denaro;

Non sarà possibile utilizzare più voucher a valore nello stesso ordine;

Il voucher a valore si applicherà ad un solo articolo per ordine;

Il voucher a valore si applicherà solo ad articoli il cui valore di vendita superi di almeno 1 euro il valore del voucher stesso. Non può essere applicato ad articoli appartenenti alla Sample Sale o vendite di beneficenza.

Nel caso in cui tu voglia esercitare il diritto di recesso previsto dall’art. 52 del Codice del Consumo e restituire un articolo sul quale hai applicato il voucher a valore, dovrai seguire la procedura di reso standard consultabile nella sezione Resi. Una volta che il tuo reso è stato accettato, il relativo codice sarà riattivato con il suo valore originale. La differenza di spesa che hai sostenuto per l'acquisto dell'articolo ti sarà riaccreditata secondo le modalità ed i termini previsti per la normale procedura di rimborso.

I VALUE VOUCHER POTREBBERO NON ESSERE DISPONIBILI AL MOMENTO DELL’ ACQUISTO CONSEGUENTEMENTE L’UTENTE DEVE VERIFICARE L’ATTIVAZIONE DEL SERVIZIO PRECEDENTEMENTE ALL’ORDINE.

MODALITÀ DI PAGAMENTO

Per il pagamento del prezzo dei prodotti e delle relative spese di spedizione e consegna, se previste, l’Utente potrà seguire una delle modalità indicate nel modulo d’ordine.

In caso di pagamento mediante carta di credito, la procedura di pagamento si svolgerà tramite connessione protetta collegata direttamente all’istituto bancario titolare del servizio di pagamento online a cui i terzi non possono avervi accesso. In particolare, le informazioni finanziarie (es. numero della carta di credito/ debito, data di scadenza), saranno inoltrate tramite protocollo crittografato, che forniscono i relativi servizi di pagamento elettronico a distanza, senza che terzi possano aversi accesso. Tali informazioni, inoltre, non saranno mai utilizzate dal Venditore se non per completare le procedure relative al tuo acquisto e per emettere i relativi rimborsi in caso di eventuali restituzioni dei prodotti, a seguito di esercizio del tuo diritto di recesso, ovvero qualora si renda necessario prevenire o segnalare alle forze di polizia la commissione di frodi su www.Biancamilano.it. Il prezzo per l'acquisto dei prodotti e le spese di spedizione e consegna, come indicato nel modulo d'ordine, saranno addebitati sul tuo conto corrente al momento della spedizione dei prodotti acquistati, salvo il diritto dell’Utente di vedersi riaccreditato l’importo in caso di inadempimento da parte del Venditore o mancata esecuzione del contratto per qualsiasi ragione.

L’Utente è l’unico responsabile dei dati immessi pertanto garantisce di utilizzare solo carte di credito/ debito di cui ha la legittima disponibilità.

MODALITÀ DI CONSEGNA

I prodotti vengono consegnati, tramite corrieri convenzionati, direttamente all’Utente all’indirizzo di spedizione specificato nell’ordine.

Compilando la scheda anagrafica nella procedura di conclusione dell’ordine necessaria ad attivare l’iter per l’esecuzione del presente contratto e le ulteriori comunicazioni, l’Utente autorizza il Venditore a comunicare i dati anagrafici ai corrieri e/o spedizionieri di fiducia utilizzati per la consegna dei prodotti acquistati in modo da permettere le procedure necessarie al loro recapito.

Il Venditore farà il possibile per evadere l’ordine trasmesso entro 2 giorni lavorativi e comunque non oltre 30 giorni a decorrere dal giorno successivo a quello in cui l’Utente ha trasmesso l’ordine. I tempi di consegna comprendono solo giorni lavorativi e non prevedono le festività.

Il Sito consente di richiedere la consegna dei prodotti ordinati ad un indirizzo diverso da quello proprio dell’Utente a condizione che sia compreso nel paese di spedizione dell’ordine; in ogni caso è onere dell’Utente indicare tutti i riferimenti necessari al buon esito della consegna.

Non è mai possibile ritirare i prodotti acquistati attraverso il Sito direttamente presso il magazzino del Venditore. Le spese e le tipologie di spedizione previste possono variare a seconda del Paese e delle modalità di spedizione scelte dall’Utente. Dette spese ed ogni eventuale costo aggiuntivo sono a carico dell’Utente. Il relativo importo sarà espressamente e separatamente indicato nel riepilogo dell’ordine, prima che l’Utente proceda alla trasmissione dello stesso, nonché nell’e-mail di conferma dell’ordine.

Sia in Italia che all’estero la procedura di consegna prevede che, in caso di assenza del destinatario al momento dell’accesso del corriere, l’incaricato lascerà un avviso, al fine di perfezionare successivamente la spedizione, nel quale verranno indicati i recapiti da contattare per concordare la seconda consegna. In caso di mancato accordo per la seconda consegna il pacco rimarrà in giacenza presso il magazzino del corriere e sarà onere dell’Utente provvedere al ritiro. Nel caso di mancato ritiro entro 4 giorni il pacco verrà restituito al Venditore. In tal caso il contratto dovrà intendersi risolto ai sensi dell’art. 1456 c.c., con comunicazione del Venditore inviata a mezzo e-mail all’Utente e dunque l’ordine sarà annullato.

L’Utente ha sempre la possibilità di verificare lo stato del proprio ordine attraverso l’apposito link inserendo il numero del proprio ordine o attraverso la propria area personale nell’ipotesi si sai preventivamente registrato su www.Biancamilano.com.

OBBLIGHI DELL’UTENTE

È fatto severo divieto a persone minorenni di concludere un ordine nel Sito. I dati inseriti in fase di acquisto devono essere esclusivamente i propri reali dati personali e non di terze persone, oppure di fantasia. Il Venditore si riserva di perseguire legalmente ogni violazione ed abuso, nell’interesse e per la tutela dei consumatori tutti.

L’Utente manleva il Venditore da ogni responsabilità derivante dall’emissione di documenti fiscali errati a causa di errori relativi ai dati forniti dall’Utente, essendone egli stesso unico responsabile del corretto inserimento. All’atto di ricevimento dei prodotti, l’Utente è tenuto a verificare la conformità degli stessi in relazione all’ordine. In particolare, dovrà prestare attenzione alla corrispondenza tra numero di colli indicato sulla lettera del vettore e quelli consegnati e all’integrità della confezione. Eventuali anomalie (es. manomissioni, danneggiamento) dovranno essere specificate per iscritto direttamente nel documento di trasporto del corriere e l’Utente dovrà rifiutare la consegna. Contestualmente, l’Utente è tenuto a segnalare il fatto al Servizio Clienti del Venditore attraverso l’apposito link. Qualora l’Utente accettasse la consegna di prodotti manomessi, danneggiati, decadrà dalla garanzia legale di conformità dei prodotti.

RESPONSABILITÀ

Il Venditore non assume alcuna responsabilità per i disservizi imputabili a causa di forza maggiore quali, a titolo esemplificativo, incidenti, esplosioni, incendi, scioperi, terremoti e altri eventi che impediscono in tutto o in parte, di dare esecuzione al contratto nei tempi concordati.

Il Venditore non sarà responsabile nei confronti di alcuna parte o di terzi in merito a danni, perdite e costi subiti a seguito della mancata esecuzione del contratto per le cause sopra citate, avendo il cliente diritto soltanto alla restituzione del prezzo corrisposto.

Parimenti, il Venditore non è responsabile dell’eventuale uso fraudolento ed illecito che possa essere fatto da parte di terzi, di carte di credito, assegni ed altri mezzi di pagamento, all’atto del pagamento dei prodotti. Il Venditore infatti, in nessun momento della procedura d’acquisto è in grado di conoscere il numero di carta di credito dell’Utente il quale, aprendosi una connessione protetta, viene trasmesso direttamente al gestore del servizio bancario.

DIRITTO DI RECESSO

L’Utente può esercitare il diritto di recesso e restituire il prodotto ricevuto, senza alcuna penalità e senza specificarne il motivo, nel rispetto dei termini e delle modalità qui di seguito riportate.

L’Utente può sempre effettuare la richiesta di reso direttamente dal Sito, accedendo al proprio profilo, compilando ed inoltrando al Venditore la richiesta di reso nel termine di 14 giorni dalla consegna.

I prodotti dovranno essere restituiti integri, non danneggiati e provvisti del codice a barre e di ogni eventuale altro sigillo che faccia parte dei prodotti; i prodotti che vengano restituiti incompleti, rovinati, danneggiati, deteriorati non saranno rimborsati.

Il Venditore, in caso di esercizio del diritto di recesso, ha la facoltà di non accettare la restituzione o non rimborsare integralmente le somme corrisposte per l’acquisto, in relazione a quei prodotti che siano sprovvisti del relativo cartellino di garanzia (inteso quale “security seal”) o che siano stati alterati nelle loro caratteristiche essenziali e qualitative o che siano stati danneggiati.

I prodotti che si intendono rendere devono essere consegnati allo spedizioniere entro 14 giorni decorrenti dalla comunicazione dell’Utente al Venditore della propria volontà di recedere dal contratto.

Le spese di restituzione dei prodotti conformi saranno a carico dell’Utente. Dopo la restituzione dei prodotti, il Venditore provvederà ai necessari accertamenti relativi alla conformità degli stessi alle condizioni e ai termini ivi indicati.

Qualora il diritto di recesso venga correttamente esercitato il Venditore provvederà al rimborso delle eventuali somme già incassate dall’Utente per l’acquisto dei prodotti al netto delle spese di spedizione.

Qualunque sia la modalità di pagamento utilizzata dall’Utente, il rimborso è attivato dal Venditore nel minor tempo possibile e comunque entro 14 giorni dalla data in cui il Venditore è venuto a conoscenza dell’esercizio del diritto di recesso, previa verifica della corretta esecuzione del medesimo e verifica dei prodotti restituiti.

Il Venditore esegue il rimborso utilizzando lo stesso mezzo di pagamento adoperato dall’Utente per l’acquisto dei prodotti restituiti, anche nel caso in cui sia stata utilizzata una carta di credito virtuale e/o usa e getta. Il Venditore non potrà in alcun modo effettuare un rimborso su carta di credito diversa da quella utilizzata per l’acquisto, ad eccezione del caso in cui la carta stessa sia scaduta nel frattempo o sia stata rubata: in tal caso l’Utente potrà inviare un’e-mail a www.Biancamilano.com per concordare il mezzo di rimborso più appropriato.

GARANZIA DI CONFORMITÀ

Ai sensi di legge il Venditore ha l’obbligo di consegnare all’Utente beni conformi al contratto di vendita ed il Venditore risponde per eventuali difetti di conformità dei prodotti esistenti al momento consegna o che si manifestino entro due anni dalla consegna.

Ai fini della validità della garanzia che precede l’Utente deve denunciare al Venditore il difetto di conformità entro due mesi dalla scoperta, a pena di decadenza, contattando il Servizio Clienti tramite apposito link. La denuncia dovrà contenere la descrizione accurata e completa dei vizi e difetti contestati.

Il Servizio Clienti provvederà a comunicare all’Utente le istruzioni per la restituzione del prodotto difettoso che avverrà a spese del Venditore.

L’Utente avrà diritto di chiedere la risoluzione del contratto e la restituzione di quanto pagato o, in via alternativa, la sostituzione del prodotto. In caso di vizio/ difetto lieve l’Utente avrà solo diritto alla sostituzione del prodotto.

In ogni caso sono esclusi dalla garanzia legale i difetti di conformità derivanti da danneggiamenti dovuti a fatti accidentali o da responsabilità dell’Utente per uso non conforme alla destinazione d’uso del prodotto.

LEGGE APPLICABILE

Ogni controversia relativa all’applicazione, esecuzione, interpretazione e violazione dei contratti di vendita stipulati tramite il Sito è sottoposta alla legge italiana. È espressamente esclusa l’applicazione della Convenzione delle Nazioni Unite sui Contratti di Vendita Internazionale di Merci. In ogni caso, saranno fatti salvi i diritti eventualmente attribuiti al Consumatore da disposizioni inderogabili di legge vigenti nello Stato di residenza o domicilio di quest’ultimo.

MODIFICHE E AGGIORNAMENTI

Il Venditore si riserva il diritto di modificare il Sito, le politiche e le presenti Condizioni Generali di Vendita in qualsiasi momento per offrire nuovi prodotti o servizi, ovvero conformarsi a disposizioni di legge o regolamentari. L’Utente che accede al Sito e inoltra un ordine aderirà alle politiche e ai termini delle Condizioni Generali di Vendita di volta in volta vigenti al momento in cui l’ordine sarà effettuato, salvo che eventuali modifiche non abbiano efficacia retroattiva in forza della legge applicabile. Qualora una delle ivi presenti previsioni fosse ritenuta invalida, nulla o inapplicabile, tale condizione non pregiudicherà comunque la validità e l’efficacia delle altre previsioni.
